Terms and Conditions

These Terms and Conditions (the “Terms”) govern your use of our GPS vehicle tracking platform, its websites, mobile applications and APIs (together, the “Service”). The Service is offered under several brand names, including TrakWay, HTS Tracking and DreamsTrack. By creating an account, installing a device, or using the Service in any way, you agree to these Terms. If you are agreeing on behalf of a company, you confirm that you are authorised to do so.

1. The Service

The Service collects location and telemetry data from GPS tracking devices installed in vehicles and makes it available to you through our applications and APIs. What is available to a particular account depends on the devices linked to it, the features enabled for it, and the plan it is on.

We may add, change or withdraw features. Where a change materially reduces functionality you rely on, we will give reasonable notice through the Service or by email.

2. Your account

You are responsible for everything done under your account, including by sub-accounts you create. Keep your credentials and API keys confidential; an API key is equivalent to a password and grants whatever access it was created with. Tell us promptly at support@sensoitgps.com if you believe an account or key has been compromised.

You must give accurate account information and keep it current. We may suspend an account that appears to be compromised, is being used unlawfully, or is materially overdue for payment.

3. Tracking people, and consent

Vehicle tracking produces information about the people driving those vehicles. You are responsible for having a lawful basis to collect it and for telling those people that tracking is in place, as required by the laws that apply to you. This typically includes employees, contractors and anyone else who drives a tracked vehicle.

You must not use the Service to track a person or a vehicle without the right to do so. We may suspend an account where we reasonably believe it is being used for covert or unlawful surveillance.

4. Accuracy and availability

GPS positions are estimates produced by hardware and satellite signals we do not control. Accuracy varies with device quality, installation, satellite visibility, terrain, buildings, tunnels and weather. Mobile networks lose coverage, and devices lose power and fail.

The Service is therefore provided on a best-effort basis and is not suitable as the sole basis for emergency response, safety-critical decisions, or legal or disciplinary action against an individual. Verify anything consequential independently.

We aim to keep the Service available continuously but do not guarantee uninterrupted operation. Maintenance, third-party outages and network failures can interrupt it.

5. Acceptable use

You agree not to:

  • use the Service unlawfully, or to harass, stalk or endanger anyone;
  • attempt to access accounts, devices or data that are not yours, or probe or test the security of the Service without our written permission;
  • resell or redistribute the Service unless your agreement with us permits it;
  • place a load on the Service that degrades it for others, including exceeding published API rate limits or circumventing them;
  • reverse engineer the Service, except to the extent that restriction is unenforceable where you live.

6. Devices, SIMs and installation

Tracking hardware and its SIM connectivity may be supplied by us or by a third party. Unless your agreement says otherwise, you are responsible for lawful and competent installation and for keeping the device powered and intact. Damage, disconnection or tampering will interrupt data and is not a failure of the Service.

Where connectivity is supplied as part of a plan, it is for the tracker’s own use only.

7. Your data

The location and telemetry data produced by your devices remains yours. You grant us the rights needed to host, process and display it in order to provide the Service, and to keep backups.

We may use aggregated, de-identified information that cannot reasonably be linked to you, your drivers or your vehicles to operate and improve the Service.

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.

8. Fees, renewal and non-payment

Paid plans and device subscriptions are billed in advance for the period stated at purchase. Unless stated otherwise, fees are non-refundable once a period has begun. Taxes are additional where applicable.

If a subscription lapses, the affected devices stop reporting into your account. We retain the historical data for the period described in the Privacy Policy so that reactivating restores it, after which it may be deleted.

9. Suspension and termination

You may stop using the Service at any time and may ask us to close your account. We may suspend or terminate an account for a material breach of these Terms, for unlawful use, or for non-payment that remains uncured after notice.

On termination your right to use the Service ends. Export anything you need first; we are not obliged to retain your data after an account is closed beyond the retention periods in the Privacy Policy.

10. Third parties

The Service depends on third parties including mobile networks, satellite positioning, mapping and geocoding providers, hosting providers and messaging providers. Their failures can affect the Service, and their own terms may apply to features that use them.

11. Warranties and liability

The Service is provided “as is” and “as available”. To the fullest extent permitted by law we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of business, or loss or inaccuracy of data. Our total liability arising out of or relating to the Service in any twelve month period is limited to the fees you paid us for the Service in that period.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

12. Changes to these Terms

We may update these Terms. The “Last updated” date above shows when. Where a change is material we will give reasonable notice through the Service or by email. Continuing to use the Service after a change takes effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of India, and the courts of Chennai, Tamil Nadu have exclusive jurisdiction over any dispute arising from them, unless a separate signed agreement between us says otherwise.
